Recordkeeping Compliance Certification and Contact Information Registry Filings Due April 1, 2025

The FCC has released a Public Notice to remind service providers and equipment manufacturers that are subject to Section 255, 716, or 718 of the Communications Act to maintain records of their efforts to make their services and equipment accessible to people with disabilities. These records could include information about their efforts to consult with individuals with disabilities, descriptions of accessibility features, and information about the compatibility of their services and products with peripheral devices or specialized equipment commonly used by individuals with disabilities. Annual recordkeeping compliance certifications and required contact information must be filed with the FCC by April 1, 2025.

The certification requirement applies to providers of interconnected and non-interconnected VoIP service, electronic messaging service, interoperable video conferencing service, and any audio or video communications service used by inmates to communicate outside a correctional institution, regardless of the technology used. Manufacturers of equipment for these services also are required to certify.

Certifying entities must file three pieces of information:

  1. certification of their annual recordkeeping compliance;
  2. their current contact information for consumers; and
  3. their current US agent for service contact information.

Failure to file each of these items may result in an enforcement action.
