Supreme Court Strikes Down Federal Prohibition On Sports Betting

The U.S. Supreme Court has struck down a federal law that prohibited states from authorizing sports betting. The decision allows each state to determine for itself whether to legalize wagering on professional and amateur sports within its borders. Casino operators in several states, including New Jersey, West Virginia, and Mississippi, reportedly already have legislative approvals in place to begin offering sports betting within a matter of weeks. Other states, lured by the prospect of revenues generated from sports betting, are expected to follow suit. The Supreme Court’s decision and the resulting spread of legalized sports betting could affect broadcasters. For years, radio and TV stations have been able under certain circumstances to accept casino advertising promoting lawful gaming activities, but broadcasters have generally avoided running spots for sports betting. The Supreme Court’s action, however, could lead to an increase in advertising from casinos and daily fantasy sports companies such as DraftKings and FanDuel looking to promote their now legal sports betting services.
