FCC Declares AI-Generated Voice Calls Subject to Prior Express Consent

The FCC issued a Declaratory Ruling clarifying that calls which use AI to generate human voices constitute an “artificial or prerecorded voice call” for purposes of the Telephone Consumer Protection Act (TCPA) and its implementing rules. Consistent with the Declaratory Ruling, unless a call is made for emergency purposes or is otherwise exempt from the TCPA’s requirements, a caller must obtain the level of consent required by the FCC’s rules to place any call that uses AI to generate a human voice. The Declaratory Ruling is effective immediately.
