Digital Discrimination Rules to Take Effect March 22, 2024

The Digital Discrimination Rules addressing “equal access to broadband internet access service” are set to take effect March 22, 2024. Rule amendments applying the informal complaint process to investigations of digital discrimination are delayed indefinitely at this time. For a summary of the new rules, see Lerman Senter’s prior alert, New FCC Rules Aim to Prohibit Discrimination in Broadband Internet Access.

What This Means for You

Entities covered by the rules, including broadband internet access service providers and entities “that facilitate and affect consumer access to broadband internet access service,” are encouraged to review existing policies and practices that could be impacted by these rules.
