Lerman Senter has helped American Tower Corporation obtain a novel waiver of FCC rules relating to tower lighting. Pursuant to the waiver, American Tower's obligation to conduct on-site inspections of the lighting control systems on 4,600 of its towers every three months was reduced to a yearly requirement. The waiver request emphasized that the high-tech tower monitoring equipment used by American Tower provides safety protections not contemplated when the rule was promulgated in 1943.
