LS Member Dennis P. Corbett was interviewed on the John "Spud" McConnell Show as broadcast on Entercom’s WWL (New Orleans) on Wednesday, April 29th, concerning FCC regulation of broadcast indecency and profanity. The appearance came the day after the Supreme Court's 5-4 decision in FCC v. Fox Television Stations, where the Court rejected a procedural challenge to the FCC’s decision to change a longstanding policy on “fleeting expletives.” Under the new policy, the FCC has the latitude to penalize broadcasters for the live broadcast of even a single “indecent” or “profane” word. The Supreme Court declined to address the Constitutional issues raised by the FCC’s regulation of fleeting expletives, but remanded the case to the Second Circuit in New York, which will now consider those First Amendment issues.
