In the field of wireline and wireless access and service, Lerman Senter has represented domestic carriers, U.S.-based international carriers, large foreign carriers, and new domestic entrants in competitive fields before the FCC, NTIA, state public utility commissions, Congress, the federal courts, and foreign regulatory bodies.

Our clients have provided myriad services, including domestic and international switched voice telephony on a pre-subscribed and non-presubscribed basis, cellular service and personal communications services (PCS), paging, specialized mobile radio (SMR), multi-point multi-channel distribution services (MMDS), private line services, frame relay services, high-speed data services, internet backbone access services and international call-back services.

We have assisted clients in negotiating arrangements for capacity with satellite and submarine cable operators, and by developing and negotiating operating and settlement of accounts agreements with clients' foreign correspondents. We have obtained authority for domestic clients to provide intrastate telecommunications services from state public utility commissions throughout the United States, and advised clients on widely varying state tariffing and rate requirements, universal service, other regulatory obligations and rules regarding the marketing of telecommunications services. We also participated in the numerous rulemaking proceedings that have implemented the 1996 Telecom Act and set new regulatory policy.

For our international telecommunications clients, we have obtained authority to establish or gain access to facilities to provide international services, to resell the international services of other carriers, and to assign or transfer control of authorizations to provide international services. We have also advised many clients on the structuring of corporate acquisitions or the establishment of new companies to achieve compliance with the FCC's rules regarding affiliations between U.S. and foreign-licensed carriers. The firm has extensive experience assisting international carriers in complying with FCC regulatory obligations, including the preparation and filing of tariffs, traffic, revenue and circuit status reports, regulatory fee payments and equal employment opportunity filings.

Representative Matters

  • Successfully prosecuted applications for authority to provide intrastate telecommunications services before state public utility commissions throughout the continental United States. Secured grant of the first FCC license to provide international service to a foreign-controlled U.S. carrier
  • Successfully prepared and prosecuted SMR and MMDS license applications and modifications, conducted due diligence in connection with the sale of SMR and MMDS licenses, and prepared environmental assessment guidelines for an SMR client
  • Advised and assisted minority-owned competitive carrier for local, long distance, wireless and cable services and secured regulatory authorizations to enter various markets throughout the country
