In our memorandum of
June 29, 2011, we explained that the Sunrise Period for the .XXX domain
name registry will begin on September 7, 2011. During this period,
trademark owners will be able to place their federally registered trademarks
on a “block list” and thereby prevent those marks from being registered as
domain names in the .XXX registry. The Sunrise Period was
recently extended from 30 to 50 days, and is now scheduled to run through
October 28, 2011. Domain names in the .XXX registry will become
available to the general public through accredited registrars and their
resellers on December 7, 2011 following a “land rush” period for members
of the adult entertainment industry, which begins on November 8. Accredited registrars are
offering a “pre-registration” service through which trademark owners can
pre-register their marks for inclusion in the “block list” when the Sunrise
Period opens. Whether you use one of these pre-registration services or
wait until the Sunrise Period officially opens, we encourage you to submit all
of your federally registered marks for inclusion on the “block list” in order
to prevent your marks from being registered by a third party in the .XXX
domain name registry. If you would like to
include your registered trademark on the “block list,” or have any other
questions about the .XXX domain name registry, please contact Louis J. Levy (llevy@lermansenter.com;
202-416-6748), or any other attorney in our office. August 5, 2011 |
