Auction 91 Now Scheduled For April 27, 2011

Procedures and Minimum Opening Bid Amounts for Auction of 144 FM Construction Permits Announced

The FCC’s Wireless Telecommunications and Media Bureaus have announced a new commencement date and pre-auction deadlines for the auction of 144 new, vacant non-reserved FM allotments, including 37 construction permits that were offered but not sold in Auction 79.  Designated as Auction 91, the auction is now scheduled to commence on April 27, 2011.  The Bureaus have removed three construction permits from the original list of construction permits scheduled for auction (Channel 250C1 at Tuba City, Arizona; Channel 285A at Union Gap, Washington; and Channel 254C2 at Ennis, Montana).  An updated list of the vacant allotments for which construction permits will be auctioned, including the upfront payments and minimum opening bids associated with each construction permit, is available here.

Auction 91 will employ simultaneous multiple round bidding.  The auction will be conducted over the Internet using the FCC Auction System, but telephonic bidding will be available as well.

Those wishing to participate in Auction 91 must submit electronically a short-form application on FCC Form 175.  The FCC Form 175 filing window opens at 12:00 noon Eastern Time (“ET”) on January 31, 2011 and closes at 6:00 p.m. ET on February 10, 2011.  In addition, a sufficient upfront payment and FCC Remittance Advice Form (FCC Form 159) must be submitted by 6:00 p.m. ET on March 21, 2011.
