FCC EXTENDS DEADLINE TO FILE COMMENTS ON RETRANSMISSION CONSENT RULEMAKING PETITION

The FCC has extended by one month the deadlines to file comments and reply comments on the Petition for Rulemaking that proposes significant changes to the retransmission consent rules.  Comments are now due by May 18, 2010, with reply comments now due June 3, 2010.  The FCC extended the deadlines at the request of the NAB, which expressed concern that parties in attendance at the NAB’s annual convention ending on April 15 would not have had sufficient time to file comments and reply comments by the original deadlines.

As we reported here, the Petition requests the FCC to initiate a rulemaking proceeding to require dispute resolution when retransmission consent negotiations are at an impasse and to impose mandatory interim carriage while dispute resolution proceedings are being conducted.  Both of these proposals would reduce the bargaining power of broadcast television stations during the retransmission consent negotiating process.  The Petition was collectively filed by fourteen entities, including DIRECTV, Inc., DISH Network LLC, Time Warner Cable Inc., Verizon and Cablevision Systems Corp.
